Personal bankruptcy, in most circumstances, can be resolved through Chapter 7 or 13 of the Bankruptcy Code. This and the following page will cover the basics of these two chapters of the Code  

In my initial interview with my clients I am most interested in their gross income, net income after deductions, and their cost of paying for the necessities of life such as: Home mortgage or rent payments, cost of utilities, vehicle costs ( maintenance, insurance, registration, etc)  cost of food, clothing and other necessities of the family unit. 

If the cost of living for reasonable and necessary living expenses is equal to (or nearly equal to) or exceeds the monthly net income, most likely all debts which are dischargeable through bankruptcy can be administered through the Chapter 7 provisions of the Bankruptcy Code. 

Depending on the amount of personal property owned by the client, most cases can be administered as a “No Asset” Case and all of the dischargeable debt of the Client will be discharged without giving up the family home, automobile or other personal belongings. 

If there is excess value over what can be exempted, the matter can be administered as an asset case. 

Due to the number if issues that may arise in an asset case, and the potential complexity of those issues, I will discuss your options regarding such matters at our initial confidential interview.
