A Chapter 13 case in Bankruptcy is a method of repaying all or a portion of your debt to some or all of your creditors over a period of time. 

The time span and monthly payment in a Chapter 13 Case is be based on the type of debt, the total amount owed, and available income after deductions for the reasonable and necessary living expenses incurred on a monthly basis. 

This is a great way to pay taxes which are not dischargeable, mortgage and auto arrearage, as well as certain other obligations which would still be owed in a Chapter 7 case.    

The time to repay in such a plan is generally between 3-5 years but may be much shorter if the personal circumstances permit. 

In both Chapter 7 and 13 Cases your creditors are prohibited from harassing you in anyway, wage garnishments are stopped in most cases, and civil judgments may be eliminated. 

To qualify for protection under Chapter 13, you must have a regular income with enough excess income after deductions for your basic living expenses to make a regular monthly payment to the Chapter 13 Trustee over the life of the plan. 

AND REMEMBER, AS IN A CHAPTER 7 CASE, ONCE I AM RETAINED, THE CREDITOR CALLS MUST STOP,
